What information do we collect and process from the user through the website?
The data collected refers to identifiable data categories, such as: Name and Surname, Phone Number, Email, as well as the IP address from which the user accesses the data collection form.

If the user provides data of third parties, they will assume responsibility for having informed them in advance and obtained their consent, as per Article 14 of the GDPR.
What is the purpose of processing the user’s personal data?
BENIU processes personal data for the following purposes, depending on the reason for which the data was provided:
- To provide the contracted products/services, maintain the contractual relationship, and follow up on it.
- To contact, process, manage, and respond to the user’s request, inquiry, or issue (whether by email, contact form, or phone).
- To manage the customer’s purchase process and any inquiries related to the contracted products/services.
- To manage, if applicable, the sending of information regarding products, services, and updates related to BENIU via electronic and/or conventional means.
What is the legal basis for processing the user’s data?
- The legal basis for processing the user’s personal data for the purposes outlined above is the performance of the corresponding service, and it is an imperative obligation, as stated in Article 6.1,b) of the GDPR.
- Regarding the sending of information about products, services, and updates related to BENIU, the legal basis for processing the provided personal data is the explicit consent granted by the user, as stated in Article 6.1,a) of the GDPR.
For how long will the user’s personal data be processed?
- The data for managing the customer relationship and billing and collecting for services will be kept for as long as the contract is active. Once this relationship ends, the data may be kept for the time required by applicable law and until the expiration of any potential responsibilities arising from the contract.
- The data for managing inquiries and requests will be kept for as long as necessary to respond to them, and if applicable, until the data subject withdraws their consent to receive information related to their inquiry.
- The data for sending information about products or services from BENIU will be kept until the user revokes their consent.
To which recipients will the user’s personal data be communicated?
As a general rule, your data will not be transferred to third parties unless there is a legal obligation or it is necessary to provide the service. Considering this:
- The user’s personal data may be shared with financial entities through which the management of collections and payments is processed.
- Only in cases legally required, the data will be communicated to Law Enforcement Agencies.
- They may also be communicated to the competent Public Administrations in the cases provided by law.
- If applicable, the data will also be shared with the Data Processors of BENIU for proper service provision.
What are the user’s rights?
The data protection regulations allow you to exercise your rights of access, rectification, deletion, portability, opposition, and restriction to processing, as well as not to be subject to decisions based solely on the automated processing of your data, when applicable.
These rights are characterized as follows:
- Exercising these rights is free, unless the requests are manifestly unfounded or excessive (e.g., repetitive in nature), in which case BENIU may charge a fee proportional to the administrative costs incurred or refuse to act.
- You may exercise your rights directly or through a legal or voluntary representative.
- We must respond to your request within one month, although if the request is complex or numerous, this period may be extended by another two months.
- We are obligated to inform you about the means to exercise these rights, which should be accessible and we cannot refuse you the exercise of the right simply because you choose another method. If the request is submitted electronically, the information will be provided through electronic means where possible, unless you request otherwise.
- If BENIU does not process the request, we will inform you, at the latest, within a month of the reasons for not acting and the possibility of filing a complaint with a supervisory authority.

To exercise your rights, BENIU offers the following methods:
1. By sending a written and signed request to BENIU. Ref: LOPD Rights Exercise.
2. By sending the scanned and signed form to the email address info@beniu.es with the subject “LOPD Rights Exercise.”
In both cases, you must verify your identity by providing a copy or scanned copy of your ID or an equivalent document to ensure that we only respond to the interested party or their legal representative, who must provide proof of their representation.
Furthermore, especially if you feel you have not been fully satisfied in exercising your rights, we inform you that you may file a complaint with the national supervisory authority by contacting the Spanish Data Protection Agency (AEPD), C/ Jorge Juan, 6 – 28001 Madrid ( www.aepd.es ).
What security measures have we implemented?
At BENIU, we are committed to protecting your personal information.
We use reasonable and effective physical, organizational, and technological measures, controls, and procedures designed to preserve the integrity and security of your data and ensure its privacy.
Additionally, all personnel with access to personal data have been trained and are aware of their obligations regarding the processing of personal data.
In the case of contracts with our providers, we include clauses requiring them to maintain confidentiality regarding the personal data they have accessed due to the contracted service, as well as to implement the necessary technical and organizational security measures to ensure the confidentiality, integrity, availability, and permanent resilience of the personal data processing systems and services.
All these security measures are reviewed periodically to ensure their adequacy and effectiveness.
However, absolute security cannot be guaranteed, and no security system is completely impenetrable. In the case that any information under our control is compromised due to a security breach, we will take appropriate measures to investigate the incident, notify the Supervisory Authority, and if necessary, inform affected users to take appropriate measures.
Social Media Policy
BENIU has a corporate profile on the LinkedIn social network.
Therefore, BENIU is the “Data Controller” of your data by virtue of having these profiles on social media and because the user follows us, and we may follow them as well.
This means that if the user decides to join our corporate profile as a follower or “Like” our content or profile, they accept this policy, where we explain their rights and how we use their data.
As the data controller, we ensure confidentiality in processing and compliance with the user’s rights, always under the scope of the applicable data protection regulations.
Additionally, we inform you that we will use these social media platforms to announce news or relevant information related to the services we offer or topics we believe may be of interest to the user. Using the platform’s functionalities, the user may receive such information on their feed or profile.
However, we also inform you that there is no link between BENIU and these platforms or social networks. Therefore, the user accepts their usage policy and terms and conditions when accessing them and/or validating their notices and terms during registration, with BENIU not being responsible for the use or processing of user data outside the strict relationship and service provision outlined in this policy.

We warn you that BENIU holds all intellectual and industrial property rights to the website, as well as to all its elements (including, but not limited to: images, sound, audio, video, software, or text; trademarks or logos, color combinations, structure and design, selection of materials used, computer programs necessary for its operation, access, and use, etc.).
The website of BENIU contains texts intended to inform its users. Any errors or omissions in the generated content will not make BENIU responsible in any case.
